Terms and Conditions

We're stoked to have you on board. Before we dive in, we need to cover just a few things.

These terms set out the full agreement between you and Hot Stuff Saunas Pty Ltd (ABN 81 667 471 374), and replace any previous versions we may have had. By filling out a rental form, placing an order, or continuing to use your sauna, you're agreeing to stick to these terms.

We've kept the legal stuff in here to make sure everything's clear and fair - but we've written it in plain English so it actually makes sense.

1. Definitions

Agreement: These Terms & Conditions and your order form (submitted online or signed).
Company: Hot Stuff Saunas Pty Ltd (ABN 81 667 471 374).
Client: You – the person or business renting the sauna.
Equipment: The sauna being rented.
Rates: Weekly hire charges.
Term: Weekly hire period with a 1, 3, or 6-month minimum, continuing until cancelled with 21 days’ written notice.
Site: The place where the sauna is installed.

2. Hire Terms

Rental begins on the agreed start date.
Minimum terms are 1, 3, or 6 months (as selected).
After that, hire continues week-to-week until you give 21 days’ written notice.
You can switch to a longer term and get a lower weekly rate with written agreement from us.

3. Payments & Bond

Rent is paid weekly in advance via direct debit.
A refundable bond is due before delivery.
We may deduct costs (e.g. damage, cleaning, unpaid rent, or early termination fees) from the bond.
Any balance will be refunded within 14 days of return.
If the bond doesn’t cover all costs, we’ll invoice you for the remainder.
We may suspend your rental and arrange recovery of the sauna if any amount remains unpaid beyond 7 days, even if your minimum hire term is ongoing.

4. Cancellations & Termination

You can cancel anytime after the minimum term with 21 days’ notice.
If you cancel early, the remaining minimum-term weeks must still be paid.
We may terminate the agreement for any reason with 48 hours’ notice.
If you breach the agreement (e.g. fail to pay), we may immediately terminate and repossess the sauna without notice.

5. Late Payments & Default

To cover the cost of payment follow-ups and processing, a $25 late fee applies to missed payments.
Interest will also accrue on overdue amounts at an annual rate of 12%, calculated daily.
If payment remains unpaid after 7 days, we may:Report your account to credit agencies;Refer your case to debt collectors (minimum 20% + GST recovery fee);Begin legal recovery proceedings.
You are liable for all debt collection and legal costs.

6. Equipment Use & Care

Keep the sauna clean and safe, and don’t move, modify, or sublease it without our approval.
It must not be used commercially or in public without written permission.
You must supervise its use and inspect it regularly.
We recommend you perform regular safety checks and keep a basic record of sauna use and inspections.
You must follow all manufacturer instructions and safety advice, and must not use the sauna for any unlawful, hazardous, or medically contraindicated purposes.
You’re responsible for making sure your site is suitable and safe for installation and use.

7. Faults, Damage & Breakdowns

Notify us within 3 hours of any issue.
If the issue is due to our fault, we’ll repair, replace, or refund.
If it’s due to misuse or damage, you’re responsible for repairs or replacement.
We are not responsible for delays caused by issues outside our control, including delays to parts or service availability

8. Delivery, Return & Access

We’ll inspect the sauna with you upon delivery and again on return.
If the sauna is returned in a worse condition (excluding fair wear and tear), you’ll be charged for repairs and may continue paying rent until it’s fixed.
You must give at least 21 days' written notice before arranging collection or return.
If the sauna isn’t available for pickup at the agreed time, extra charges may apply.
If the sauna is unavailable for collection or access is denied at the scheduled time, a failed collection fee of $250 will be charged to cover labour and logistics.

9. Loss or Total Damage

If the sauna is lost, stolen, or damaged beyond repair while in your care, you’re liable for the full replacement cost.
We may require you to replace it at your own expense.

10. Insurance

We strongly recommend insuring the sauna under your home or contents policy.
You're liable for theft, fire, or major damage if it’s not insured.
We are not liable for any insurance excess or damage waiver costs you incur.

11. Ownership & Security Interest

You’re renting the sauna - it remains our property.
You cannot sell, assign, offer as security, or remove the sauna from the site without approval.
We may register a security interest on the Personal Property Securities Register (PPSR) to protect our rights.

12. Liability & Indemnity

You acknowledge that you’ve assessed the sauna’s suitability for your needs, site, and electrical setup. We make no guarantee that the sauna is fit for your particular purpose or conditions.
We are not liable for any direct or indirect loss, injury, damage, or delay arising from the use, installation, operation, failure, or removal of the sauna, except where liability cannot be excluded by law.
Our total liability to you (if any) is strictly limited to 20% of the total rental payments you have made to us.
We are not liable for any special, incidental, indirect, punitive, or consequential loss or damage, including but not limited to loss of profit, business interruption, increased costs, or damage to property, even if we were advised of the possibility of such damage.
You agree to indemnify and hold us harmless from and against any claim, loss, damage, cost, expense (including legal and investigation costs), injury or liability:arising from your use, misuse, operation, or failure to maintain the sauna;arising from damage to property or injury to any person (including you, your family, guests, visitors, or pets);caused by failure to follow manufacturer or safety instructions;caused by unauthorised modification, movement, or use of the sauna;arising from your breach of this agreement or any applicable law.
This indemnity applies even if a claim is brought against us due to alleged negligence, unless liability cannot be excluded under the Australian Consumer Law.
Nothing in this agreement limits or excludes any rights you may have under the Australian Consumer Law. These rights include guarantees that our rental goods will be of acceptable quality, fit for purpose, and match any description or sample provided.

13. Permits & Licences

You’re responsible for obtaining and paying for any permits or approvals required to use the sauna at your property.
You agree to indemnify us for any costs or claims arising from non-compliance with local laws.

14. Repossession Rights

If you breach the agreement, become insolvent, or fail to pay, we may enter your property to recover our sauna without prior notice.
You must grant us access when requested for inspections, servicing, or collection.

15. Force Majeure

We’re not liable for delays or non-performance due to events outside our control (e.g. natural disasters, pandemics, power outages, supplier issues).

16. Assignment

You can’t assign or transfer this agreement or the sauna without our written consent.
We may assign our rights at any time.

17. Entire Agreement & Jurisdiction

These terms make up the entire agreement between us.
Any previous agreements are overridden.
This agreement is governed by Western Australian law and disputes will be handled in WA courts.

18. PPSA Consent

You agree that this agreement creates a security interest under the PPSA, and you authorise us to register our interest.

19. Optional Purchase

At any time during your rental, you may choose to purchase your sauna. We will provide a buyout quote based on the model, its condition, and the total rental payments made to date.
There is no obligation to purchase - you are always free to continue renting or to return the sauna after your minimum hire term.
This arrangement is a rental only. You are not entering into a consumer lease or hire-purchase agreement. Nothing in this clause creates an obligation or expectation that you must buy the sauna.
